Welcome to ShareCards. By using the ShareCards app and services, you agree to these Terms of Service. Please read them carefully.
ShareCards is operated by Nikhil Johns Sandipogu (individual developer).
1. Eligibility
You must be at least 13 years old to use ShareCards. By using the app, you represent that you meet this requirement.
If you are under 18, you should have your parent or guardian's permission to use the app and agree to these Terms.
We may require you to verify your age or identity where we offer such options.
2. Your account and responsibility
You are responsible for keeping your account credentials secure and for all activity that happens under your account.
You must provide accurate information when you create your account and keep it up to date.
You may not create an account using a false identity or on behalf of someone else without permission.
You may not share your account with others or allow others to use your account.
3. User-generated content (UGC)
3.1 Ownership
You own the content you create and post on ShareCards (cards, comments, messages, photos, etc.), subject to these Terms and applicable law.
3.2 License you grant to us
By posting content on ShareCards, you grant us a non-exclusive, royalty-free, worldwide license to host, store, display, reproduce, and distribute that content only as needed to operate, promote, and improve the app — for example, showing your cards on the map, delivering messages, backing up data, and enforcing our policies.
This license continues for a limited time after you delete content or your account, to the extent needed for backups, legal compliance, and safety.
3.3 Your responsibility
You are responsible for your content. You must not post content that:
Infringes anyone else's intellectual property or other rights.
Is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
Violates our Community Guidelines.
4. Prohibited content and behavior
You agree not to:
Post content that is illegal, promotes illegal activity, or harms others.
Harass, bully, threaten, or intimidate others.
Post hate speech, or content that promotes violence or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or similar characteristics.
Post sexual or sexually suggestive content involving minors, or content that exploits minors.
Spam, scam, or use the app for phishing or fraud.
Share others' private personal information without consent (doxxing).
Use bots, scrapers, or automated tools to collect data or interact with the app in unauthorized ways.
5. Reporting, blocking, and moderation
Reporting: You can report cards, comments, messages, or users that you believe violate our policies. We do not guarantee a specific response time.
Blocking: You can block other users. Once blocked, they will not see your content in their feed/map, and you will not see theirs; messaging is also restricted.
We reserve the right to monitor, review, or remove content at our discretion to maintain safety and compliance.
6. Direct messages and communications
Direct and group messages are between you and the participants. You must not use messaging for spam, harassment, scams, or illegal activity.
We may access or retain message content only as needed to operate the service, comply with law, or enforce our policies. You should not assume that messages are private from a legal or law-enforcement perspective.
7. Termination and suspension
By you: You may stop using the app at any time. You may request account deletion (see our Privacy Policy for how we handle data on deletion).
By us: We may suspend or terminate your account if we believe you have violated these Terms or our Community Guidelines, or for other operational or legal reasons. After termination, your right to use the app stops immediately.
8. Disclaimers
The app and services are provided "as is" and "as available." We do not guarantee that the app will be error-free, uninterrupted, or free of harmful components.
We are not responsible for the conduct of users or for content posted by users. You use the app and interact with others at your own risk.
9. Limitation of liability
To the fullest extent permitted by law, ShareCards and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of data, profits, or goodwill) arising from your use of the app or these Terms.
Our total liability for any claims shall not exceed the greater of: (a) the amount you paid us in the twelve months before the claim, or (b) one hundred U.S. dollars ($100).
10. Indemnification
You agree to indemnify and hold harmless ShareCards and its operator from and against any claims, liabilities, damages, losses, and expenses arising out of or related to: (a) your content, (b) your use of the app, or (c) your violation of these Terms or applicable law.
11. Governing law and disputes
These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles.
Any dispute arising from these Terms or the app shall be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.
12. General
Entire agreement: These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and ShareCards.
Severability: If any part of these Terms is found unenforceable, the rest remains in effect.
Waiver: Our failure to enforce any right or provision does not waive that right or provision.
Changes: We may update these Terms from time to time. Continued use after changes means you accept the new Terms.
